Licence Terms:
Licensor: PrestaPremium Zbigniew Stanejko (62-025 Kostrzyn, Półwiejska 3A/F17, Poland)
Licensee: The natural or legal person who has purchased a licence for the software (details below).
Definitions: “ Installation ” means a single instance of PrestaShop running in a separate directory with its own database; “ Domain ” means a unique host name (for example: example.com). “ Subdomain ” and “ alias ” shall mean, respectively, subdomains and aliases that operate within the same installation.
- Perpetual Licence
The Licensee is granted a perpetual licence to use the software for PrestaShop within the scope set out in this agreement. The licence is non-transferable, non-exclusive and non-sublicensable, except as expressly provided herein. - Product
The software covered by the licence constitutes the product related to the PrestaShop platform, including modules, themes or other software components (hereinafter referred to as the "software"). - Prohibition on Resale
The Licensee shall not resell, rent, sublicense, assign or otherwise transfer the rights to use the software to any third party. The licence is intended solely for the internal use of the Licensee. - Software Installation
The Licensee is entitled to install the software on a single PrestaShop installation associated with one domain. The licence covers aliases and subdomains of the primary domain only where they are served by the same installation. In the event the multishop feature is used within that single installation, multiple stores may be supported on that installation without an additional licence. Separate, independent PrestaShop installations (for example on different servers or using separate databases) each associated with different domains require a separate licence. Technical support, updates and warranty relate to the installation/domain specified in the order; extension of support to additional installations or domains requires a separate agreement or fee. - Domain Change
The Licensee is entitled to one change of the domain assigned to the purchased licence, subject to the provisions of this clause. Where testing is planned, the Licensee should provide a test domain at the time of purchase; upon completion of testing the Licensee may request a change to the production domain.
Requests to change to a production domain must be submitted by email to shop@prestapremium.com no later than 3 days from the commencement of use of the production domain. The request must include complete information necessary for verification, in particular:- order number,
- product name,
- current domain,
- new domain.
- Modifications to the Software
Modification of the software by the Licensee or by third parties shall void the warranty, unless the modified software is repaired by the producer or an authorised provider. - Warranty Period
The warranty on the software is twelve (12) months from the date of purchase. During the warranty period the producer will provide fixes for defects and updates to the software that are consistent with its original functionality. - Exclusions from Warranty
The warranty does not cover: - damage resulting from interference with the software by the Licensee or third parties,
- issues caused by other software or incompatibility with third-party software,
- damage resulting from improper operation of the server or environment on which the software is installed.
- Licensee
The Licensee may be any natural or legal person who purchases the software (module, theme or other component) from the Licensor. The licence is assigned to the purchaser indicated in the order and the licence terms are uniform for all customers. - Licence Verification
The Licensor reserves the right to periodically verify compliance with the licence terms, including checking the domain and installations on which the software has been deployed. Where unauthorised use on additional, independent installations or domains not covered by the order is detected, the Licensee shall procure additional licences or pay a fee to extend the licence. In the absence of regularisation, the Licensor may revoke the licence without refund and take other measures available under this agreement. - Termination of Licence
In the event of refund of payment by the Licensor (for example due to cancellation of the transaction), this licence agreement shall terminate and the Licensee shall lose the right to use the software. All claims and disputes related to the agreement shall cease on its termination. - Copyright Protection
The Licensor reserves the right to implement technical protections in the software to prevent unauthorised use. Any circumvention of such protections shall constitute a breach of the licence terms. - Licensor
The producer of the software and the granting party of the licence is PrestaPremium Zbigniew Stanejko, who provides support and updates to the software in accordance with the terms of this licence. - Limitation of Liability
The Licensor shall not be liable for any damages arising from improper use of the software by the Licensee, including financial loss, business interruption or other indirect damages. In particular, the producer shall not be liable for damages resulting from: - incorrect use of the software, including use contrary to instructions provided by the producer,
- improper operation of the server on which the software is installed,
- conflicts with other software installed in the Licensee's environment,
- loss of data or issues arising from the Licensee's failure to perform backups.
- Audit and Enforcement of Licence Terms
The Licensor is entitled to carry out audits to verify whether the Licensee complies with the terms of this licence agreement. An audit may include verification of software installation(s) and compliance with the licence conditions. The Licensee shall cooperate with the Licensor in the course of any such audit. If breaches of the licence terms are found, the Licensor may take appropriate measures to enforce the agreement, including imposing financial penalties or revoking the licence without refund. - Protective Mechanisms and Consequences of Circumvention
The Licensor reserves the right to implement technical protective measures in the software intended to prevent unauthorised use, including licence keys, online verification systems and encryption. Any attempt to circumvent, modify or remove such protections will be treated as a breach of the licence terms and may result in immediate termination of the licence and potential legal liability for the Licensee. - Final Provisions
The Licence Terms may be amended by the Licensor, in which case the Licensee will be informed prior to purchase. This agreement is governed by the law applicable in the Licensor's country. - By using the software, the Licensee confirms that they have read and accept the terms of this licence in full.
