Licence Terms:

Licensor: PrestaPremium Zbigniew Stanejko (62-025 Kostrzyn, Półwiejska 3A/F17, Poland)
Licensee: A natural or legal person who has acquired a licence for the software (details below).

  1. Lifetime Licence
    The licensee receives a lifetime licence to use the software for PrestaShop as specified in this agreement. The licence is non-transferable, non-exclusive, and non-assignable.
  2. Product
    The software subject to the licence is a product related to the PrestaShop platform, including modules, templates, or other software elements, hereinafter referred to as the “software”.
  3. Resale Prohibition
    The licensee is not authorised to resell, rent, sublicense or transfer the right to use the software to third parties. The licence is solely for the internal use of the licensee.
  4. Software Installation
    The licensee is authorised to install the software on a single domain. In the case of using the multishop feature within one PrestaShop installation, it is possible to manage multiple shops on the same installation.
  5. Software Modifications
    Modifying the software by the licensee or third parties results in the loss of warranty, unless the modified software is repaired by the manufacturer or an authorised supplier.
  6. Warranty Period
    The warranty for the software is 12 months from the date of purchase. Under the warranty, the manufacturer provides bug fixes and software updates that are in line with its original functionality.
  7. Warranty Exclusions
    The warranty does not cover:
    • Damages resulting from interference with the software by the licensee or third parties.
    • Issues caused by other software or incompatibility with software from other manufacturers.
    • Damages resulting from improper server operation or environment in which the software is installed.
  8. Licensee
    A licensee may be any natural or legal person who purchases the software (module, template, other software element) from the licensor. The licence is assigned to the purchaser specified in the order, and the terms of the licence are uniform for all customers.
  9. Licence Verification
    The licensor reserves the right to periodically verify the compliance of the licence usage, including checking the domain where the software has been installed. In the event of a violation, the licence may be revoked without refund.
  10. Licence Expiry
    In the event of a chargeback by the licensor (e.g., due to cancellation of a transaction), the licence agreement expires, and the licensee loses the right to use the software. Any claims and disputes related to the agreement expire upon its termination.
  11. Copyright Protection
    The licensor reserves the right to implement technical protections in the software to prevent unauthorised use. Any attempt to circumvent these protections is a violation of the licence terms.
  12. Licensor
    The manufacturer of the software and the licensor is PrestaPremium Zbigniew Stanejko, who provides support and software updates in accordance with the terms of this licence agreement.
  13. Limitation of Liability
    The licensor is not liable for any damages resulting from improper use of the software by the licensee, including financial losses, business interruptions, or other indirect damages. Furthermore, the software manufacturer is not responsible for damages caused by:
    • Incorrect use of the software, including failure to follow the instructions provided by the manufacturer.
    • Improper server operation where the software is installed.
    • Conflicts with other software installed in the licensee’s system.
    • Data loss or issues related to the lack of backup performed by the licensee.
  14. Audit and Enforcement of Licence Terms
    The licensor has the right to conduct audits to verify whether the licensee is complying with the terms of this licence agreement. The audit may include verifying the software installation and checking compliance with the licence terms. The licensee agrees to cooperate with the licensor during such audits. In the event of any violations of the licence terms, the licensor may take appropriate action to enforce the terms of the agreement, including imposing financial penalties or revoking the licence without refund.
  15. Protective Mechanisms and Consequences of Circumventing Them
    The licensor reserves the right to implement technical protections in the software to prevent unauthorised use, including but not limited to, licence keys, online verification systems, and encryption. Any attempts to bypass, modify, or remove these protections will be treated as a breach of the licence terms and may result in the immediate expiry of the licence, as well as legal consequences for the licensee.
  16. Final Provisions
    The licence terms may be changed by the licensor, and the licensee will be informed of these changes prior to making a purchase. This agreement is governed by the law applicable in the licensor’s country.
